A. The city council hereby establishes a city of Bothell LEOFF-1 disability board. This board shall perform all functions, exercise all powers and make all determinations as defined under Chapter 41.26 RCW and Chapters 415-104 and 415-105 WAC. These shall include but not be limited to: authorizing disability leave, determining whether said disability is incurred in the line of duty or not, determine length of disability leave, termination of disability leave, retirement for disability and authorization of payment for member health benefit claims.

B. All city of Bothell police officers and firefighters who first became members of the law enforcement officers’ and fire fighters’ retirement system prior to October 1, 1977, shall be subject to the city of Bothell LEOFF-1 disability board findings subject to appeal procedures defined in Chapter 41.26 RCW and Chapters 415-104 and 415-105 WAC.
