A. Cut and fill slopes shall be set back from site boundaries in accordance with this section, the recommendations of a geotechnical engineering report or soils engineered report that has been peer-reviewed by the city, and the provisions of the critical area regulations of Chapter 14.04 BMC. Setback dimensions shall be measured on a horizontal plane.

B. The top or toe of cut or fill slopes, rockeries, shoring, cast-in-place and precast concrete retaining walls, timber retaining walls, and modular large block walls such as ecology block or similar, which are placed upon lands that are not geologically hazardous as defined by Chapter 14.04 BMC, shall be placed consistent with the recommendations of a geotechnical engineering report or soils engineering report that has been peer-reviewed by the city and as required under the terms of this chapter. The setback shall be increased when necessary to stabilize any required subsurface drainage or surcharge, as determined by a geotechnical engineering report, soils engineering report or engineering geology report that is peer reviewed by the city.

C. The grade elevations and cut and fill amounts and dimensions established in the grading permit application shall be prepared based on the adopted city of Bothell datum and topographic data. (Ord. 2269 § 1, 2018).
