Where physical conditions render compliance with the conditions of this code governing side sewer installation impracticable, the public works director may issue a special permit for installation of a side sewer requiring compliance with the provisions insofar as is reasonably possible, but such permit shall be issued only upon condition that the property owner execute and deliver to the city an instrument in form furnished by the city agreeing to save harmless and indemnify the city for any damage or injury resulting from substandard installation.
