Prior to release of any construction bond or surety, the developer shall covenant to replace, repair or correct any defect in workmanship or materials in the conveyed facilities that shall occur or otherwise arise during a period of two years following date of acceptance by the city, and shall provide a bond to secure the covenant. The applicant shall further waive and release the city from any and all future claims for damages on behalf of the applicant and the applicant’s successors in interest which may be suffered by reason of connection to the water system. The bond shall be in a form acceptable to the city attorney. (Ord. 1634 § 1, 1996).
