It shall be a requirement for anyone to secure a right-of-way invasion permit to pay a fee, to be established by the city council by resolution, to mitigate the impact of the invasion of the city street on the life and required maintenance for the street resulting from the street invasion. “Person” as used herein means any individual, association, firm, partnership, corporation and governmental unit, subdivision or agency. The funds received by the city from the payment of the fee required by this section shall be accounted for separately and used exclusively for use in city street overlay and reconstruction projects and to offset the costs of acquiring and maintaining a pavement management system to more effectively monitor the condition and maintenance/repair requirements of city streets.
